2010 Candidate Survey Questions

 General:  some of the questions asked in this survey may not be pertinent to the office you seek, however your answer to these questions will be valuable in the decision making process of the sporting electorate. So please take the time to answer all questions.

 

Note: All questions were to be answered by either Yes, No or Abstain.

 

 

1.       In the past we have tried on many occasions to get Palm Beach County to build a public shooting range.  In fact a couple years ago County Staff came up with elaborate plans to build a range on property that abuts the County Sheriff’s range. There was a huge turn out at two public hearings with many private entities pledging financial support. When it came before the County Commission they delayed and finally permanently tabled the idea. 

 

Would you support and vote for a public shooting range that would be an asset that would attract sportsmen to this county?       [Go Back] 

 

2.       On April 26, Governor Jeb Bush SIGNED SB-436, the "Castle Doctrine" into law (Chapter No. 2005-27) that took effect on October 1, 2005. 

 

This bill established, in law, the presumption that a criminal who forcibly enters or intrudes into your home or occupied vehicle is there to cause death or great bodily harm; therefore a person may use any manner of force, including deadly force, against that person. It removes the "duty to retreat" if you are attacked in any place you have a right to be. You no longer have to turn your back on a criminal and try to run when attacked. Instead, you may stand your ground and fight back, meeting force with force, including deadly force, if you reasonably believe it is necessary to prevent death or great bodily harm to yourself or others. [This is an American right repeatedly recognized in Supreme Court gun cases.] It provides that persons using force authorized by law shall not be prosecuted for using such force. It also prohibits criminals and their families from suing victims for injuring or killing the criminals who have attacked them.

In short, it gives rights back to law-abiding people and forces judges and prosecutors who are prone to coddling criminals to instead focus on protecting victims.

3.       Gun control advocates claim that semi-automatic firearms with certain cosmetic features are so-called "assault weapons." However, all semi-automatic firearms are functionally the same (one round fired per one pull of the trigger.)

 

Would you oppose any legislation that reauthorizes the 1994 law, which sunset in 2004, which banned many types of semi-automatic firearms (commonly referred to as "assault weapons”)?       [Go Back]

 

4.       The Supreme Court ruled in Heller (2008) that: "The Second Amendment guarantees an individual's right to possess a firearm unconnected with service in a militia," and that the District of Columbia's ban on operable firearms in the home violated that right. Nevertheless, D.C. officials have subsequently passed a law that is nearly as restrictive as the old one, and it now includes a "microstamping" provision that could impact gun owners nationwide.

5.       Legislation in Congress seeks to ban private firearm sales at gun shows unless the buyer submits to a federal background check.

6.       The federal so-called gun free school zones act of 1996 makes it illegal, (with very limited exceptions) to possess a firearm within 1,000 feet of the property of any "public, private or parochial school." Gun owners who are otherwise carrying a firearm legally can be subject to a five year prison sentence simply for driving past a school.

7.       Though there is no technical definition of a "high capacity" magazine (firearm ammunition feeding device), gun control proponents designate some magazines as "high, capacity" based on an arbitrarily chosen number of rounds a magazine can hold.

 

Would you oppose legislation banning the manufacture, sale or possession of large-capacity magazines?       [Go Back]

 

8.       Gun control advocates are seeking to prohibit 18-20 year-olds from possessing firearms, which would treat young adults as if they have no Second Amendment rights even though they are old enough to serve in the armed forces and vote.

9.       Gun control advocates arc seeking to ban .50 caliber firearms based only on the bore size, although such firearms are only a mere fraction of an inch larger than many common hunting rifles.

10.     The Justice Department reported in 1989 that, "Any system that requires a criminal history record check prior to the purchase of a firearm creates the potential for the automated tracking of individuals who seek to purchase a firearm." This means that any background check - whether an "instant check" or otherwise — can result in a registration list of gun owners.

 

Would you support a repeal of the 1993 Brady instant cheek as it is in direct conflict with existing laws prohibiting the assembly of a records database?       [Go Back]

 

11.     Gun control advocates have proposed the ballistic marking ("Micro-stamping) of all fired cartridge casings.

 

Would you oppose any legislation requiring that cartridge casings be "micro-stamped" with a unique Identification code?       [Go Back]

 

12.     In 1996, Congress enacted a gun ban known as the Lautenberg Domestic Misdemeanor Gun Ban. Because this ban covers misdemeanors, it disarms otherwise law-abiding citizens for life — for offenses as slight as spanking a child or grabbing a spouse's wrist.

13.     Legislation in Congress would allow a person who can legally carry a concealed firearm in his or her home state to also have the right to carry in other states. The specific legislation we support does not establish national standards for concealed carry and is "Vermont-friendly" in that it recognizes the right to concealed carry from states that do not require a permit to carry.

14.     Gun control advocates are seeking to require gun owners to keep firearms inoperable with a trigger lock or other locking device when not in use.  With this initiative, a firearm becomes effectively useless if actually needed to defend one’s family.

 

Would you oppose any legislation mandating that trigger locks be applied to all firearms when not in use?       [Go Back]

 

15.     Gun control advocates are seeking to require that gun owners keep firearms locked away in a safe when not in use.  Again, the ability to use the firearm to defend one’s family is diminished.

 

Would you oppose any legislation requiring firearms intended for self-protection to be locked up when not in use?       [Go Back]

 

16.     The Gun Control Act of 1968 requires that imported firearms be "suitable for sporting purposes."

17.     In 2007, the Congress passed the "Veterans Disarmament Act" without a vote in either house. This legislation disarms hundreds of thousands of military veterans who are suffering from ailments that frequently follow combat stress. The gun ban, therefore, denies veterans and other Americans their Second Amendment rights not on the basis of the conviction of a crime, but rather on the basis of a doctor's opinion.

18.     The BATFE has been cited in recent years for putting gun dealers out of business through trumped up paperwork "offenses" by arbitrarily banning firearms and components from importation by bureaucratically reclassifying them.  Additionally, the BATFE has illegally converted semi-automatic firearms into machine guns in order to prosecute innocent Americans for owning the weapons that were legal before they were tampered with by government employees.

 

If elected to Congress, will you use your position to rein in the BATFE?       [Go Back]

 

19.     Rep. Roscoe Bartlett has introduced legislation that would remove the free speech restrictions on advocacy groups like ours, enabling such groups to discuss in broadcast media the voting records of members of Congress right up to an election?
